THE family of Mongolian model Altantuya Shaariibuu have won a civil suit initiated in 2007, a year after she was killed by two police officers.
Azilah and Sirul led the police to the scene of the crime separately, as Azilah was arrested a few days after the murder, and Sirul on Nov 6, 2006, after returning home from official duty overseas. If not for Abdul Razak, Azilah and Sirul would not have taken the deceased in their car from his residence and ultimately kill her. However, a five-member Federal Court overturned the decision in January 2015, ruling both officers guilty of murder. Sangeet Kaur Deo, Tan Chee Kian and Simranjit Kaur Chhran acted for Altantuya’s family in the lawsuit, while Azilah and Sirul were not represented. “The first defendant (Azilah) did not know the deceased. The only link was the third defendant (Abdul Razak), who wanted to stop harassment [by Altantuya],” the judge said, noting Altantuya had come to Malaysia to seek compensation from Abdul Razak for translation work done in Paris. (Previous reports said that the work was in relation to the purchase of the two Scorpene submarines that Malaysia had acquired from France.) Abdul Razak then called Azilah and told him Altantuya was outside his house. Musa had dispatched Azilah to meet with the political analyst. The government presented three witnesses while Abdul Razak chose not to testify. Altanshagai’s name was removed from the list of plaintiffs after he died in 2017. The trial continues on Jan 6 next year. The court also ordered Rosmah, 70, to be jailed for 30 years if she fails to pay the fine. Besides the solar case, Rosmah is also facing money laundering and tax evasion charges. On Nov 25, the High Court allowed former Attorney-General (AG) Tan Sri Tommy Thomas' application to quash the suit filed by Najib over alleged misfeasance in public office for prosecuting him on charges involving the 1MDB and ruled that the claim brought by Najib was obviously unsustainable and that there was no reasonable cause of action. Judge Ab Karim Ab Rahman said there was no direct evidence to show that the three of them committed the offence (murder) and there was no continuity between the time of the incident with them and the evidence that the three of them were the last people with the deceased, cannot be said to lead to the offence of murdering the man. She has appealed against the conviction, jail sentence and fine and the Court of Appeal has set March 31 next year for the hearing. On Oct 28, the High Court ruled that the prosecution failed to prove that the RM9.5 million received by the lawyer from Najib was proceeds from unlawful activities and that based on the testimony of the prosecution witnesses, there was no evidence of predicate action (illegal activity) involved and where the money was obtained from. Peter appealed over the decision and the High Court fixed Jan 27 next year to hear his appeal to set aside the conviction and sentence. On the same day, another High Court ordered Muar Member of Parliament Syed Saddiq Syed Abdul Rahman to enter his defence on four charges of abetting in CBT, misappropriation of assets and money laundering in relation to Armada's fund. Not satisfied with the ruling, the prosecution filed an appeal to the Court of Appeal on Sept 26, and the court has fixed Jan 10` next year for case management. On Jan 24, the High Court ordered him to enter his defence on all the charges and so far, the defence has called six witnesses, including Ahmad Zahid, himself, to testify. The spotlight was also on Najib's wife, Datin Seri Rosmah Mansor, as a week after that, she was found guilty of three graft charges in connection with the solar hybrid project worth RM1.25 billion for 369 rural schools in Sarawak and was sentenced to 10 years in prison and a fine of RM970 million by the Kuala Lumpur High Court on Sept 1.

The only difference for overseas-born children is whether their Malaysian parent is a father or mother. Rosmah’s bid to set aside her conviction and jail sentence in the RM1.25 billion Sarawak rural schools’ solar hybrid energy project handed down by the High Court will be heard by the Court of Appeal on June 22 and 23. In 2019, the High Court allowed the prosecution’s appeal and remitted the case back to the Magistrate’s Court for Sam to enter her defence on the reckless driving charge. In her bid, the Hindu mother is seeking declarations that her children are Hindu and that the children are legally unfit to embrace Islam without her approval. In April this year, the High Court allowed the prosecution’s appeal and convicted Sam of driving recklessly and sentenced her to six years in jail and RM6,000 fine. In August, Loh succeeded in obtaining leave from the High Court for her judicial review against the unilateral conversion of her three children to Islam by her ex-husband without her consent. Based on Najib’s review application, he is seeking for the Federal Court to make several court orders, such as to either order his acquittal in the SRC case or to have his entire SRC trial to be reheard by a different High Court judge, or for his entire SRC appeal to be reheard by a new Federal Court panel of at least seven judges. The Magistrate again discharged and acquitted Sam at the end of the defence case prompting the prosecution to file the second appeal to the High Court. His trial started on June 21, 2022, at the High Court and he was called to enter his defence in October. The prosecution had filed a notice of appeal to the Court of Appeal on September 26 this year against the High Court’s decision to acquit and discharge the former home minister of all the charges after ruling that the prosecution had not made out a prima facie case against him. Najib was previously found guilty in the High Court on July 28, 2020, over the misappropriation of SRC International Sdn Bhd’s RM42 million, and lost his appeal at the Court of Appeal on December 8, 2021, against his conviction and sentencing. Separately, the prosecution’s appeal against the decision of a High Court to acquit Ahmad Zahid of 40 charges of corruption in connection with the foreign visa (VLN) system has been fixed for case management on January 10.
